After a meeting with the Peaks of Otter Family Medicine, Inc., a Virginia corporation (“Peaks” or the “Corporation”), Board of Directors referenced in Memorandum: Health Care Compliance Program Assignment, the Board unanimously voted to adopt a healthcare compliance program for the practice. The Board also voted to hire you as a consultant to help the Corporation implement the compliance program. The Office Manager, Sally Johnson, who also serves as the Treasurer and COO for the Corporation, will be the point person for this project and is your main point of contact.
Sally and some of the Board members have questions about the implementation of and tailoring of a compliance program for Peaks. Therefore, Sally has asked you to publish a memorandum to her and the Board that will answer these questions. Specifically, the memorandum should address the following:
• What steps will need to be taken to implement and tailor a good compliance program for the Corporation?
• What challenges or obstacles are likely to be faced in implementing and tailoring a good compliance program for the Corporation?
• Costs are obviously a concern for any business. What costs should the Corporation expect to face? Must a full-time compliance person be hired or can Sally handle it on the inside with your help as an outside consultant when needed?
• Are there other issues that they should be thinking about as they embark on this process?
